and make the lease negotiation process more successful, here are some helpful tips:

 

 

Start the process early –You will need plenty of time to thoroughly complete the entire process; creating a timeline will

assist in determining the requisite number of months to complete each of the major phases, from preliminary research to

due diligence and document execution, space planning and construction cost analyses and finally to move in. 

 

 

 

Create a sound negotiating strategy – Negotiating is all about leverage and the advantages it creates.  Since there is always

leverage imbalance throughout the process, formulating a strategy to favor or improve your leverage is of upmost importance.

 

 

 

Understand current and future market conditions – It is imperative to understand the past to better forecast the future

market conditions and trends as timing is always a critical component of the process.  Having the capability to produce

historical reports on vacancies, rental rates and the intricacies of each building is critical to the formulation and success of

a successful strategy.

 

 

 

Have more than one option – Develop as many building alternatives as practical that are both qualified and acceptable to

you and your specific needs.

 

 

 

Thoroughly complete due diligence – Develop a thorough knowledge of the inclusions in Base Building Conditions and

Materials as well as the costs associated with the completion of any construction.  Carefully evaluate operating expenses

(base year and future years) and understand how they apply.

 

 

 

Hire a professional and experienced real estate broker – There are few things in life that are free!  It is the Landlord’s

responsibility to pay the commission to the tenant representation broker.  However, the tenant representation broker’s

fiduciary responsibility is with you, the client.
